These Terms of Service (“Terms”) govern your access to and use of the website [www.yourbeaglebreeder.co.za] (the “Website”), including any puppy enquiries, reservations, deposits, purchases, or related communications with [Your Kennel / Breeder Name] (“we”, “us”, “our”).
By accessing or using the Website, making an enquiry, submitting a deposit, or purchasing a puppy, you agree to be bound by these Terms. If you do not agree, please do not use the Website or proceed with any transaction.
We are a small, responsible Beagle breeder based in Johannesburg, Gauteng, South Africa, committed to ethical breeding, puppy health, and finding suitable homes.

1. Use of the Website

  • You must be at least 18 years old to use the Website or enter into any transaction with us.
  • You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use.
  • We reserve the right to modify, suspend, or discontinue any part of the Website at any time without notice.

2. Puppy Information and Representations

  • All puppies shown on the Website are bred from health-tested parents (where applicable) and raised in a home environment with proper socialization.
  • Descriptions, photos, videos, prices, and availability are provided in good faith but are not guaranteed to be error-free. We may correct errors (including pricing) without liability.
  • Puppies are living animals; no puppy is guaranteed to be free from future health issues, behavioural traits, size, colour, or temperament beyond what is reasonably expected for the breed and disclosed.
  • We comply with relevant South African laws, including animal welfare standards. Puppies are typically ready to go to new homes at 8–10 weeks of age (or older if transport is involved).

3. Enquiries, Reservations, and Deposits

  • Enquiries via the Website form, email, WhatsApp, or phone do not create a binding contract.
  • A non-refundable reservation deposit (typically [e.g., R2,000–R5,000]) may be requested to secure a specific puppy or place you on a waiting list. The deposit amount and puppy details will be confirmed in writing.

Deposits are non-refundable except:

  • If we are unable to deliver the reserved puppy due to illness, death, or other unforeseen circumstances (in which case we will refund in full or offer an alternative from a future litter).
  • As otherwise agreed in writing.
  • The balance of the purchase price is due before or on collection/handover.
  • We reserve the right to refuse any enquiry, reservation, or sale at our sole discretion (e.g., if we have concerns about suitability of the home).

4. Purchase and Transfer of Ownership

Ownership transfers only upon full payment and collection/handover of the puppy.

We will provide:

  • A written sales agreement/puppy contract (separate document) outlining specific terms, health information, vaccinations, microchip details, and any guarantees.
  • Relevant documentation (e.g., vet records, pedigree if registered, microchip certificate).
  • Transport (if requested) is at the buyer's expense and risk. We may assist with arrangements but are not liable for transport issues.

You agree to have the puppy examined by a licensed veterinarian within [e.g., 72 hours / 5 days] of handover. If a serious congenital defect is diagnosed (as certified by the vet), notify us immediately. Remedies (e.g., refund, replacement) will follow the separate puppy contract and CPA requirements.

5. Health and Guarantees

No guarantees are given.
You are responsible for ongoing veterinary care, vaccinations, deworming, nutrition, exercise, and socialization.

6. Buyer Responsibilities

You agree to:

  • Provide a safe, loving, suitable home (we may conduct basic checks/references).
  • Not resell, surrender to a shelter, or use the puppy for commercial breeding without our written consent (especially if sold on limited registration).
  • Return the puppy to us (or allow us first right of refusal) if you can no longer keep it.
  • Comply with all applicable laws (e.g., municipal by-laws on dog ownership).

7. Payments and Refunds

  • Payments are accepted via [e.g., EFT, cash on collection]. We do not store credit card details.
  • Deposits and payments are non-refundable except in specific cases outlined above or in the puppy contract.
  • No refunds for change of mind, allergies, lifestyle changes, or similar reasons.

8. Limitation of Liability

To the fullest extent permitted by South African law (including the Consumer Protection Act):

  • We are not liable for indirect, consequential, or special damages arising from use of the Website or puppy purchase.
  • Our total liability shall not exceed the purchase price paid.
  • We provide no warranties beyond those expressly stated.

9. Intellectual Property

All content on the Website (photos, text, logos) is our property or licensed to us. You may not reproduce or use it commercially without permission.

10. Termination

We may terminate your access to the Website or cancel any transaction if you breach these Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of Gauteng.
If you believe any term is unfair under the Consumer Protection Act, contact us first. You may also approach the National Consumer Commission.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here with a revised date. Continued use constitutes acceptance.
